Terms and Conditions
These Terms and Conditions (the "Terms") are the contract between you and Omno, the operator of the Omno electric-vehicle charging network in the Republic of Armenia ("Omno", "we", "us"). You can reach us at any time by email at support@omno.am or by telephone on +374 55 11 91 41.
By creating an account, by topping up your OMNO Balance, or by starting a charging session, you confirm that you have read these Terms and that you accept them. If you do not accept them, please do not use the Service.
1. Definitions
1.1 App — the Omno mobile application for drivers.
1.2 Service — the App, the OMNO Balance, the Omno charge points and the related support services described in these Terms.
1.3 Charge Point — an electric-vehicle charging station operated by Omno, and each connector on it.
1.4 Session — one charging session at one connector, from the moment charging starts until it stops.
1.5 OMNO Balance — the amount held in your account in Armenian drams (AMD), from which the cost of your Sessions is taken. Described in section 3.
1.6 Top-up — a payment that increases your OMNO Balance.
1.7 Tariff — the prices applicable at a Charge Point (per kWh of energy, and where applicable per minute or per session), as shown in the App.
1.8 OMNO Card — a physical RFID card issued by Omno that identifies you at a Charge Point. Described in section 5.
1.9 Provisional Session — a Session that did not end with a normal stop signal from the Charge Point and was closed automatically by our systems. Described in clause 4.9.
1.10 Final adjustment — the single adjustment made at the end of a Session, which may either take a further amount from your OMNO Balance or return an amount to it. Described in clause 4.6.
1.11 Terms Version — the version identifier of these Terms, shown in the App.
2. Your account
2.1 You must be at least 18 years old to create an account and use the Service. By registering you confirm that you are.
2.2 Registration is by email. You register with an email address and confirm it with a verification code we send to that address. We do not use SMS: no code, notice or confirmation under these Terms will be sent to you by SMS.
2.3 You must give accurate information. Your name and, if you provide it, your telephone number, must be correct and kept up to date. We do not verify telephone numbers, and we may be unable to reach you if the number you give is wrong.
2.4 Your account is personal. Please do not share your password, your account or your OMNO Card with anyone. A Session started through your account or with your OMNO Card is billed to your OMNO Balance. If you tell us that your account or your card has been used without your permission, we will look into it. Nothing in these Terms affects your rights under the law of the Republic of Armenia.
2.5 Keeping your account secure. Tell us immediately at support@omno.am if you believe someone else has access to your account. We may suspend an account where we reasonably suspect fraud, unauthorised access, abuse of the Service, or a risk to a Charge Point or to any person.
2.6 Devices. We record a device identifier for each device you sign in from, so that we can secure your account and let you end sessions on lost devices. See section 9.
3. OMNO Balance and payments
3.1 What OMNO Balance is. OMNO Balance is an amount you pay to Omno in advance for charging that Omno will supply to you. You can use it only to pay Omno for charging at Charge Points that Omno operates. You cannot use it to pay any other person, you cannot transfer it to another account or to another person, and Omno does not exchange it for cash, except as a return of your unused balance under section 7.
3.2 Currency and amounts. OMNO Balance is held in Armenian drams (AMD). Every amount shown in the App is shown with its currency. All amounts are whole drams; we do not round balances against you.
3.3 How you top up. You top up in the App. Before you pay, the App shows you the top-up methods available to you and any fee that applies. Where you pay by card, your card details are entered on the payment page of the bank or payment provider — Omno never sees or stores your full card number. An Omno operator may also credit your balance manually, for example to correct an error or to apply an amount we have agreed with you.
3.4 When a top-up takes effect. A top-up is credited to your OMNO Balance when the payment provider confirms the payment to us. This is normally immediate. If money has left your account and your balance has not increased within one hour, write to support@omno.am with the payment reference and we will trace it.
3.5 No interest. Omno is not a bank. Your OMNO Balance does not earn interest. Omno is not a bank and does not hold a banking licence, so your OMNO Balance is not a bank deposit and is not covered by the guarantee system for bank deposits in the Republic of Armenia.
3.6 Your balance does not expire. We do not cancel or expire unused OMNO Balance and we do not charge a fee against it. You can ask us to return your unused balance at any time under section 7.
3.7 No credit and no debt. Your OMNO Balance can never go below zero. We do not lend to you, and you can never owe Omno money for a Session. If a Session costs more than we were able to take from your balance, Omno bears the difference and will not ask you for it.
3.8 Fees. We do not currently charge a fee for topping up or for holding a balance. If we ever introduce one, we will tell you before it applies, under section 11.
4. Charging sessions and tariffs
4.1 Prices are shown before you start. The Tariff for a Charge Point is shown in the App on that station's page, before you start a Session. Prices include value added tax at the rate applicable in the Republic of Armenia.
4.2 The Tariff is fixed at the start of your Session. The prices that apply to your whole Session are the ones in force when the Session starts, even if we change the Tariff while you are charging.
4.3 Day and night prices. Energy is cheaper at night. The night price applies from 01:00 to 08:00 in the local time of the Charge Point; the day price applies at all other times. If your Session crosses 01:00 or 08:00, your receipt shows the energy split into separate lines at the two prices. Any per-minute or per-session component of the Tariff does not change between day and night.
4.4 You may need a minimum balance to start. A Charge Point may require your OMNO Balance to cover a minimum starting amount before a Session can begin. Where a minimum applies, the App shows it to you before you start. If your balance is below it, the Session will not start and you will need to top up first.
4.5 How the cost is taken. We take the cost of your Session from your OMNO Balance. Depending on the Charge Point, we may take it in instalments while you are charging and make a single final adjustment when the Session ends, or take the whole cost when the Session ends. Each instalment is the difference between the cost of the Session so far and what has already been taken, so the amounts always add up to the true cost and are never rounded against you twice. Figures that move on the session screen are an on-screen estimate; the amounts actually taken from your balance are the ones shown in your history and on your receipt.
4.6 Final adjustment. When your Session ends we price the whole Session once, using the readings reported by the Charge Point, and make a single adjustment: if the total is higher than what was already taken, we take the difference; if it is lower, we return the difference to your OMNO Balance. Your receipt shows the amount taken during the Session and the final adjustment separately.
4.7 Low balance. We monitor the cost of your Session against your balance. We may warn you when your balance is running low and may stop the Session automatically before your balance would be exhausted. This is an automated process and we cannot guarantee that a warning or an automatic stop will reach the Charge Point in time in every case, for example if the charger loses its connection. You remain responsible for keeping enough balance for the charging you want.
4.8 Meter readings. The energy measured and reported by the Charge Point is the basis of your bill. We record both the time reported by the Charge Point and the time our systems received it. If you believe a meter reading is wrong, raise it under section 7.
4.9 Sessions that end abnormally (Provisional Sessions). If a Charge Point stops reporting without properly ending a Session, our systems close the Session and mark it provisional. In that case: the amounts already taken during the Session stand; no final adjustment and no final bill are made automatically; and the Session is reviewed by a person. Your receipt shows that the Session is provisional. If the review shows we took too much, we return the difference to your OMNO Balance.
4.10 Availability. We do not guarantee that any Charge Point will be available, working, or able to deliver any particular charging speed. Charging speed depends on your vehicle, its state of charge, the ambient temperature and the electricity network, and is usually lower than the maximum rating of the Charge Point. We do not offer reservations. Please check that a connector is compatible with your vehicle before you start.
5. OMNO Cards (RFID)
5.1 A card is a key, not money. An OMNO Card holds no money and no value. It identifies you at a Charge Point so that a Session can be started and billed to your OMNO Balance in the ordinary way under section 4.
5.2 Sessions started with your card. A Session started with your OMNO Card is billed to your OMNO Balance. Please keep your card safe, as you would keep a bank card.
5.3 Lost or stolen cards. Tell us as soon as you can at support@omno.am or on +374 55 11 91 41 if your card is lost or stolen, and we will block it. Nothing in these Terms affects your rights under the law of the Republic of Armenia.
5.4 Cards and your account. An OMNO Card is issued to you for use with the Service. We may deactivate a card if your account is closed or suspended.
6. Receipts and documents
6.1 In-app receipt. After each Session you receive a receipt in the App showing the Charge Point, the start and end times, the energy delivered, the price lines (including the separate day and night energy lines described in clause 4.3), the total, the amount taken during the Session and the final adjustment. Receipts stay available in your history while your account is open.
6.2 Other payment or tax documents. If you need any further document for a payment or for a Session, write to support@omno.am and tell us what you need. We will tell you what we can provide, and provide it where we are able to. Nothing in these Terms affects your right under the law of the Republic of Armenia to receive any document that the law requires us to give you.
7. Refunds and complaints
7.1 How to raise a problem. Write to support@omno.am or call +374 55 11 91 41. Please include your account email, the date and time, the Charge Point, and the session number from your receipt.
7.2 What we do. We record every complaint and every disputed charge. Complaints and disputes are reviewed by a person: they are never closed automatically and they are never dropped. We confirm that we have received your complaint, and give you our decision, within the periods required by the law of the Republic of Armenia — and we aim to answer sooner.
7.3 How we correct a charge. If a charge was wrong, we correct it by returning the amount to your OMNO Balance, normally as soon as the review is complete. If you would rather have the money returned to the card or account you paid from, tell us and we will do that where the payment provider allows it.
7.4 Return of unused balance. You can ask us at any time to return your unused OMNO Balance. We return it to the bank card or account you topped up from, or to another account you give us. We may ask you to confirm your identity first. We return it within the period required by the law of the Republic of Armenia.
7.5 Damage to your vehicle. If you believe a Charge Point damaged your vehicle, tell us as soon as possible and, where it is safe to do so, do not use that Charge Point again. Section 8 applies.
7.6 Your rights under the law. Nothing in these Terms limits the rights you have as a consumer under the law of the Republic of Armenia. Where a clause of these Terms would give you less than the law does, the law applies.
8. Use of the Service, and liability
8.1 How you must use the Service. You must: (a) follow the instructions on the Charge Point, the rules of the site it stands on, and the instructions of your vehicle's manufacturer; (b) connect and disconnect the cable properly and safely, and not leave a cable in a way that creates a hazard; (c) not damage, open, modify, or interfere with a Charge Point, and not use a damaged Charge Point or a damaged cable; (d) move your vehicle promptly when charging has finished, so that others can use the bay. We do not currently charge a fee for leaving a vehicle connected after charging has finished; if we ever introduce one, it will be part of the Tariff and shown to you before you start a Session; (e) not resell charging, and not use the Service for a commercial charging service of your own without our written agreement; (f) not attempt to obtain charging without payment, and not tamper with metering, identification, or the App; (g) not access the Service by automated means, copy its data in bulk, or reverse-engineer it, except to the extent the law allows.
8.2 Your vehicle is your responsibility. You are responsible for your vehicle and for whether it is safe and suitable to charge. Charging an electric vehicle involves high voltages; do not charge a vehicle that is damaged, that is subject to a manufacturer's charging recall, or that is not designed for the connector you are using.
8.3 The Service is provided as available. Charge Points, the App and the networks they depend on can be interrupted by maintenance, faults, power cuts, network outages, and events outside our control. We aim to keep the Service running but we do not guarantee uninterrupted operation.
8.4 Our liability. We are liable to you for loss we cause you by failing to perform this contract or by our fault, as provided by the law of the Republic of Armenia. We do not exclude or limit our liability to you. Nothing in these Terms takes away or reduces any right or remedy that the law of the Republic of Armenia gives you as a consumer; where these Terms would give you less than the law does, the law applies.
8.5 Circumstances of insuperable force. Where the law of the Republic of Armenia relieves a party of responsibility because performance was prevented by circumstances of insuperable force, that law applies. These Terms do not extend it.
8.6 Suspension and termination. We may suspend or close your account if you break these Terms in a serious or repeated way, if we are required to do so by law, or if we reasonably suspect fraud. We will tell you why, unless the law prevents us. If we close your account, section 10 applies to your data and your unused balance.
9. Personal data and privacy
This section is our privacy notice. We process personal data in accordance with the Law of the Republic of Armenia on the Protection of Personal Data (ՀՕ-49-Ն, 18 May 2015, as amended).
9.1 Who is responsible. Omno decides why and how your personal data is processed in connection with the Service, and is responsible for it. Contact us about your data at support@omno.am.
9.2 What we collect. (a) Account data — your email address (which we verify), your full name, your telephone number if you give one (we store it but do not verify it), your interface language, and, if you upload one, your profile picture; (b) Verification codes — the code we email you when you register or reset your password; (c) Preferences — your connector-type preferences and similar settings; (d) Charging and payment data — your Sessions (Charge Point, times, energy, cost), your OMNO Balance movements, top-ups, returns and receipts, and your OMNO Card identifier; (e) Device data — a device identifier for each device you sign in from, and basic technical information needed to deliver the App; (f) Location — if you give the App permission, your device's location, used to show you Charge Points near you; (g) Support correspondence — what you write to us and our replies. We do not collect your card number: card details are entered on the payment page of the bank or payment provider and are not visible to us. We do not send you SMS and do not use your telephone number for verification. We do not use your personal data for advertising.
9.3 Why we process it, and on what basis. We process your data to create and secure your account, to provide charging and to bill it correctly, to operate the OMNO Balance, to issue receipts and to keep accounting and tax records, to answer your questions and handle complaints, to prevent fraud and misuse, and to keep the Service safe and working. We do this with your consent, which you give when you accept these Terms and this notice, and to comply with the obligations placed on us by law.
9.4 Automated processes. The low-balance stop described in clause 4.7 and the minimum-balance check described in clause 4.4 are automated. They decide only whether a Session may start or must stop; they do not build a profile of you. If you believe an automated stop was wrong, write to support@omno.am and a person will review it.
9.5 Who we share it with. We share the minimum necessary with: our bank and payment providers (to take and return payments); our email delivery provider (to send verification and service messages); our hosting and infrastructure providers; the tax authority, where the law requires it; and our professional advisers. We may disclose data where the law obliges us to. We do not sell your personal data and do not share it for anyone else's advertising. If you want to know which providers we use, write to support@omno.am.
9.6 Where your data is stored. We use hosting and infrastructure providers, and some of them may be located outside the Republic of Armenia. If you want to know where your data is stored, write to support@omno.am and we will tell you.
9.7 How long we keep it. We keep your account data while your account exists. After your account is deleted we keep records of your Sessions and payments for as long as accounting and tax law requires us to keep them, and then delete them or remove your identity from them.
9.8 Your rights. You may ask us to tell you what data we hold about you and how we process it; to correct data that is wrong or incomplete; to destroy or block data that is no longer needed for the purpose it was collected for; to stop processing that is based on your consent, by withdrawing that consent; and to object to our processing. Write to support@omno.am. We answer free of charge and within the periods the Law sets. If you withdraw your consent, we delete the data concerned, except where we must keep it by law (see clause 9.7). You may also complain to the authorised State body for the protection of personal data in the Republic of Armenia and to the courts; write to support@omno.am and we will give you that body's current name and contact details.
9.9 Security. We protect your data with encryption in transit, access control, and internal confidentiality rules. Our systems are built not to log the contents of your requests. No system is perfectly secure; if a breach affects your data we will act as the law requires.
9.10 Marketing. While you have an account we send you service messages you cannot opt out of — for example verification codes, receipts, and notices under section 11. We send you marketing only if you have agreed to it, and you can withdraw that agreement at any time. We do not send marketing by SMS.
9.11 Children. The Service is not for people under 18 (clause 2.1). We do not knowingly collect the personal data of children. If you believe a child has given us personal data, write to support@omno.am.
10. Deleting your account
10.1 How to delete. Write to support@omno.am and ask us to delete your account.
10.2 What happens. We close your account: you can no longer sign in, your email address is removed from the account and replaced with a value that does not identify you, and your profile data is deleted. Any OMNO Card linked to your account is deactivated.
10.3 What we keep, and why. Your charging sessions and the financial records of your balance are kept as accounting records, without your name or email attached to them. We keep them because the law requires us to keep records of the services we supplied and the payments we received. We do not use them to contact you or to build a profile of you.
10.4 Money left in your balance is not lost. If your OMNO Balance is positive when your account is deleted, the amount is set aside and we return it to you. Write to support@omno.am to arrange the payment; we may ask you to confirm your identity.
10.5 Deleting is final. A deleted account cannot be restored. You may register again later with a new account, which starts with a zero balance.
11. Changes to these Terms
11.1 We may change these Terms — for example when we add a service, when a payment method changes, or when the law changes. We publish the new version in the App and, where the change is significant, tell you by email before it takes effect, within the notice period required by the law of the Republic of Armenia.
11.2 How you accept a change. The App shows the Terms Version in force. When we publish a new version we will ask you to accept it. If you do not accept it, you can ask us to return your unused balance under section 7; we may then close your account.
11.3 Tariff changes are not changes to these Terms. We may change prices. A price change applies only to Sessions started after it takes effect; a Session in progress is billed at the Tariff fixed when it started (clause 4.2).
12. Governing law and disputes
12.1 These Terms are governed by the law of the Republic of Armenia.
12.2 Talk to us first. Most problems are solved fastest by writing to support@omno.am under section 7.
12.3 Courts and authorities. If we cannot resolve a dispute, it is decided by the courts of the Republic of Armenia in accordance with the law. Nothing in these Terms takes away your right as a consumer to bring a claim in those courts, or to complain to the State body responsible for the protection of consumer rights in the Republic of Armenia.
12.4 Language. These Terms are published in Armenian, English and Russian. For consumers in the Republic of Armenia, the Armenian text applies.
12.5 If any clause of these Terms is found to be invalid, the rest continues to apply.
